1. Terms and Conditions (T&C)
1. Scope of Application
These General Terms and Conditions (T&C) apply to all orders placed through the webshop of Weingut Oberfurner (www.oberfurner.com). They regulate the legal relationship between Weingut Oberfurner and its customers within the EU and Switzerland.

3. Conclusion of Contract
The display of products in the webshop does not constitute a legally binding offer but an invitation to submit an order.
By submitting the order, the customer makes a binding offer to conclude a purchase contract.
The contract is concluded when Weingut Oberfurner accepts the order by sending an order confirmation via email.
4. Prices and Payment Terms
All prices are in euros and include the statutory VAT.
Additional shipping costs will be shown separately during the ordering process.
The following payment methods are accepted:

The invoice amount is due immediately after the contract is concluded unless otherwise agreed.
5. Delivery and Shipping
Deliveries are made only within the EU and Switzerland.
The delivery time is usually 5-10 working days unless otherwise stated in the webshop.
If a product is unavailable, the customer will be promptly informed. Any payments already made will be refunded in this case.
6. Retention of Title
The delivered goods remain the property of Weingut Oberfurner until full payment is made.
7. Right of Withdrawal
Customers who are consumers within the meaning of the EU Consumer Protection Directive have the right to withdraw from the contract within 14 days without providing any reason.
The withdrawal period is 14 days from the day the customer or a third party named by the customer takes possession of the goods.
To exercise the right of withdrawal, the customer must inform Weingut Oberfurner by a clear statement (e.g., by email to info@oberfurner.com).
The cost of returning the goods is to be borne by the customer.
The following are excluded from the right of withdrawal:

Opened or damaged wine bottles

Goods that are custom-made according to the customer’s specifications
8. Warranty
The statutory warranty rights apply.
In the event of a defect, the customer is entitled to a remedy or replacement delivery. Damage caused by improper handling by the customer is excluded.
9. Liability
Weingut Oberfurner is fully liable for intent and gross negligence, as well as for injury to life, body, or health.
In cases of slight negligence, Weingut Oberfurner is only liable for the violation of essential contractual obligations. In this case, liability is limited to the foreseeable, typical damage.
10. Data Protection
The privacy policy of Weingut Oberfurner applies and can be accessed under the Privacy Policy.
11. Applicable Law and Jurisdiction
The law of the Italian Republic applies, excluding the UN Sales Convention.
The jurisdiction for any disputes arising from or related to this contract is the court responsible for the location of Weingut Oberfurner.
12. Severability Clause
If individual provisions of these T&C are found to be invalid, the validity of the remaining provisions will remain unaffected.
